Travel at 60 - Booking Terms and Conditions

1.0 GENERAL

1.1 Application of Terms

These Booking Terms & Conditions apply to all bookings made with Travel at 60 Pty Ltd (ABN 42 615 812 121) whether made:

  • with a Travel at 60 consultant by phone or email; or
  • online via our website.

References to “us”, “we”, and “our” mean Travel at 60 Pty Ltd.

Where travel products are provided by third-party suppliers (including but not limited to airlines, cruise lines, tour operators, wholesalers and accommodation providers), these Terms & Conditions also incorporate the conditions of those suppliers.

1.2 Authority to Book

The person making a booking warrants that they have full authority to act on behalf of all travellers named on the booking and to bind those travellers to these Terms & Conditions.

1.3 Acceptance of Terms by Payment

Payment of any deposit or part payment toward a booking constitutes acceptance of these Booking Terms & Conditions by all travellers named on the booking, whether or not the Terms & Conditions have been read and understood.

It is the customer’s responsibility to read, understand and agree to these Terms & Conditions prior to making any payment.

2.0 BOOKING FEES

2.1 Application of Booking Fee

A non-refundable booking fee of $50 per booking applies to most Travel at 60 bookings and is payable at the time the booking is made.

2.2 Non-Refundable Circumstances

The booking fee is non-refundable where a booking is cancelled or amended by the customer, including cancellations due to change of mind.

2.3 Consumer Law Exception

The booking fee will be refunded where Travel at 60 is unable to supply the booked services due to fault on our part, or where a refund is required under the Australian Consumer Law.

3.0 PASSPORTS AND VISAS

3.1 Responsibility

All travellers must hold a valid passport for international travel. Many countries require passports to be valid for at least six months beyond the date of return.

3.2 Australian Passport Assumption

When assisting with an international booking, we will assume all travellers hold a valid Australian passport unless advised otherwise.This assumption is made for administrative purposes only and does not constitute confirmation of eligibility to travel.

3.3 Customer Responsibility

It is the traveller’s responsibility to ensure they hold valid passports, visas and re-entry permits. Any costs incurred due to non-compliance are the traveller’s sole responsibility, except where caused by our fault.

3.4 Entry Requirements – United States and Canada

United States (ESTA/Visa Requirements)
Travel to the United States requires either a valid ESTA approval or an appropriate US visa. Eligibility for ESTA is determined solely by US authorities and cannot be guaranteed by Travel at 60.

Canada (eTA/Visa Requirements)
Travel to or transit through Canada requires either a valid eTA (Electronic Travel Authorisation) or an appropriate Canadian visa. Eligibility for an eTA is determined solely by Canadian authorities and cannot be guaranteed by Travel at 60.

All travellers are solely responsible for confirming and obtaining the correct travel authorisations and documentation required for their itinerary prior to departure.

4.0 TRAVEL INSURANCE

4.1 Recommendation

Travel at 60 strongly recommends that all travellers purchase comprehensive travel insurance to cover cancellation, medical expenses, repatriation, personal injury, loss of luggage and personal liability.

4.2 Insurance Provider Disclosure – Go Insurance and nib

Travel at 60 may receive a commission or other benefit when a Go Insurance or nib travel insurance policy is purchased through us.

Travel at 60 provides general information only and does not provide personal financial advice regarding insurance products. Before purchasing any travel insurance policy, you must read the relevant Product Disclosure Statement (PDS) to ensure it is suitable for your individual circumstances.

4.3 Customer Responsibility

It is your responsibility to ensure that any travel insurance policy you purchase meets your individual needs.

You may be asked by the Travel at 60 team to provide a copy of your travel insurance policy prior to departure. Where required by a supplier, cruise line or destination authority, failure to provide proof of required insurance may result in the booking being unable to proceed.

4.4 Evidence of Insurance

Some countries, cruise lines and tour operators require travellers to hold valid travel insurance as a condition of travel.

4.5 Claims Assistance Fee

A $50 administration fee applies where Travel at 60 is requested to provide essential documentation or assistance for insurance claims when the travel insurance policy was not issued through Travel at 60.

5.0 TRAVEL ADVICE AND HEALTH

Travellers should review official travel advice at www.smartraveller.gov.au and ensure they meet all health and vaccination requirements for their destination.

Travel at 60 recommends that you speak with your doctor or an appropriate medical professional regarding any required or recommended vaccinations, medications or health precautions relevant to your personal circumstances and travel itinerary.

6.0 PRICING

6.1 Prices Subject to Availability

All prices quoted or displayed by Travel at 60 are subject to availability at the time of booking and may be withdrawn or varied without notice until payment has been received in full.

6.2 Price Changes Prior to Full Payment

Prices are not guaranteed until full payment has been received. Until that time, prices may change due to factors outside the control of Travel at 60, including but not limited to:

  • currency fluctuations
  • airline or supplier price increases
  • fuel surcharges
  • government taxes or levies
  • changes to exchange rates
  • seasonal or promotional pricing changes
  • errors or omissions in published prices.

6.3 After Full Payment

Once full payment has been received and tickets or documents have been issued, the price of your travel arrangements is generally fixed, except where additional charges are imposed by government authorities, airlines or other Suppliers (for example, airport taxes or fuel surcharges).

6.4 Errors and Omissions

Travel at 60 takes reasonable care to ensure pricing is accurate; however, occasional errors may occur. In the event that an incorrect price is quoted or displayed due to error or omission, Travel at 60 reserves the right to correct the price and will offer you the choice of:

  • accepting the corrected price; or
  • cancelling the booking with a full refund of monies paid.

6.5 Quotes

Any quote provided by Travel at 60 is an estimate only and is not guaranteed until the booking has been confirmed and the required payment has been received.

6.6 Promotions and Special Offers

Special offers, discounts and promotional fares are subject to availability and may be withdrawn or amended at any time. Additional terms and conditions imposed by Suppliers may also apply.

7.0 DEPOSITS AND FINAL PAYMENT

Deposits are required at time of booking these are determined by our suppliers and anr subject to their terms and conditions. Final payment is due no later than 6 weeks prior to departure unless otherwise advised.

8.0 CANCELLATION FEES

Cancelled bookings incur a $200 per booking cancellation fee. Subject to Australian Consumer Law, Travel at 60 may retain up to 10% of travel costs paid on fully paid bookings to cover administration costs.

Cancelled bookings may incur supplier fees which can be up to 100% of the cost of the booking, regardless of whether travel has commenced.

Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Please note, some suppliers have non-refundable, non-changeable policies.

You agree to reimburse Travel at 60 for supplier fees incurred by us on your behalf for any booking which you change (including name changes) or cancel,

Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from that supplier.

9.0 ADDITIONAL AIRLINE CHANGE AND CANCELLATION FEES

Subject to your refund and remedy rights under the Australian Consumer Law, the following change and cancellation fees apply to all bookings (including online bookings and bookings made with a travel consultant):

  • Changes to Domestic/Trans-Tasman air bookings will incur a fee of $50 per passenger per booking in addition to supplier fees.
  • Cancellations to Domestic/Trans-Tasman air bookings will be subject to airline cancellations fees 
  • Changes to International air bookings (excluding Trans-Tasman bookings) will incur a fee of $100 per passenger per booking in addition to supplier fees.
  • Cancellations to International air bookings (excluding Trans-Tasman bookings) will be subject to airline cancellations fees 

Airline refunds can take up to 6 weeks to process. Refunds will only be paid once received from the airline.

10.0 ADDITIONAL SERVICE FEES

  • Name change or correction – $50 per booking
  • Documentation print & post / online check-in assist – $25 per booking

11.0 PAYMENTS

11.1 Credit Card Fees

  • Visa – 1.4%
  • MasterCard – 1.2%
  • American Express – 1.8%
  • Diners Club – 2.5%
  • Latitude Pay – 1.5%

12.0 AGENCY

12.1 Agency Relationship

Travel at 60 Pty Ltd acts solely as an agent for and sells travel related products on behalf of third-party suppliers including, but not limited to, airlines, cruise lines, tour operators, wholesalers, accommodation providers, car rental companies and other travel service providers (“Suppliers”).

12.2 Supplier Contracts

When making a booking with Travel at 60, you are entering into a separate contractual relationship directly with the relevant Supplier. All bookings are subject to the terms and conditions, tariffs, conditions of carriage and limitations of liability imposed by those Suppliers.

12.3 Limited Responsibility

Travel at 60 is not itself a provider of travel services and does not own, operate, manage or control any of the transport, accommodation, tours or other services booked on your behalf.

Accordingly, except to the extent caused by our fault, Travel at 60 is not responsible for the acts, omissions, errors, defaults, negligence or insolvency of any Supplier.

12.4 Supplier Changes

Suppliers may change prices, itineraries, schedules, aircraft types, accommodation or other arrangements without notice and such changes are beyond the control of Travel at 60.

Travel at 60 will not be liable for any loss, damage, cost or expense arising from such changes, except where required under the Australian Consumer Law.

12.5 Availability and Confirmation

All bookings are subject to availability and are not guaranteed until confirmed by the relevant Supplier and payment has been received as required.

12.6 Information Accuracy

Travel at 60 takes reasonable care in selecting reputable Suppliers and in providing information to you. However, all descriptions, photographs, maps, brochures and advertising material are provided by Suppliers and are intended as a guide only.

Travel at 60 does not warrant the accuracy, completeness or reliability of information provided by any Supplier.

12.7 Legal Rights

Your legal rights in connection with the provision of travel services are against the specific Supplier and not against Travel at 60, except to the extent that a problem is directly caused by our negligence or breach of these Terms & Conditions.

12.8 Assistance Only

Any assistance provided by Travel at 60 in resolving disputes with Suppliers is provided on a goodwill basis only and does not imply any acceptance of liability.

12.9 Complaint Procedure

If you have a complaint, please contact Travel at 60 directly. We will endeavour to resolve disputes promptly and in good faith prior to any formal proceedings.

13.0 CLIENT FUNDS AND TRUST ACCOUNT

13.1 ATAS Compliance

Travel at 60 Pty Ltd is accredited under the AFTA Travel Accreditation Scheme (ATAS) and complies with ATAS requirements for the handling of client funds.

13.2 Separate Client Account

All monies paid by clients to Travel at 60 for travel services are deposited into a dedicated client account which is maintained separately from the general operating accounts of the business.

13.3 Holding of Funds

Client funds held in the client account are held for the purpose of paying Suppliers for travel services booked on your behalf and will be applied to those services in accordance with your booking instructions and Supplier payment requirements.

13.4 Application of Funds

Travel at 60 is authorised to release funds from the client account to pay Supplier deposits, final payments, taxes, tickets and other travel-related charges as required to secure and fulfil your booking.

13.5 Service Fees

Booking fees, service fees, credit card surcharges and other charges payable to Travel at 60 become the property of Travel at 60 at the time of payment and are not held on trust.

13.6 Refunds

Where a refund is due to you, such refund will be processed once the relevant funds have been received back from the Supplier and reconciled in the client account. Travel at 60 is not responsible for delays in refund processing caused by Suppliers or financial institutions.

13.7 Protection of Client Funds

Travel at 60 takes reasonable steps to ensure client monies are handled securely and in accordance with ATAS standards and all applicable Australian laws and regulations.

14.0 PRIVACY AND DATA PROTECTION

14.1 Collection of Personal Information

In order to arrange and manage your travel bookings, Travel at 60 is required to collect personal information from you and other travellers on your booking. This may include names, contact details, passport information, dates of birth, payment details, travel preferences, medical or dietary information and other information necessary to facilitate your travel arrangements.

14.2 Use of Personal Information

Your personal information will be used by Travel at 60 for the purposes of:

  • processing and managing your travel booking
  • communicating with you regarding your travel arrangements
  • arranging payments and issuing travel documents
  • providing customer support and post-booking assistance
  • meeting legal and regulatory obligations.

14.3 Disclosure to Third Parties

To fulfil your booking, it may be necessary for Travel at 60 to disclose your personal information to third-party Suppliers including airlines, hotels, tour operators, cruise lines, wholesalers, insurers, government authorities and other service providers involved in delivering your travel services.

14.4 Overseas Disclosure – Australian Privacy Principle 8

Many of these Suppliers are located outside Australia. Where personal information is disclosed overseas, Travel at 60 will take reasonable steps in accordance with Australian Privacy Principle 8 to ensure that any overseas recipient of your personal information does not breach the Australian Privacy Principles in relation to that information.

By making a booking with Travel at 60, you consent to the disclosure of your personal information to overseas recipients for the purpose of arranging and providing your travel services.

14.5 Privacy Policy

Travel at 60 handles personal information in accordance with its Privacy Policy. A copy of our Privacy Policy is available upon request.

Our Privacy Policy contains further information about how we collect, use, store and disclose personal information, how you can access or correct your personal information, and how you can make a privacy complaint.

14.6 Security of Information

Travel at 60 takes reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

15.0 TRAVEL DOCUMENTS

Travel documents must be checked carefully upon receipt.

Travel at 60 provides travel documentation electronically wherever possible. If printed copies of documentation are required, these can be provided and posted for a $25 per booking fee.

16.0 CONFIRMATION OF FLIGHTS 

It is the traveller’s responsibility to reconfirm all flight departure times and schedules directly with the airline within 24 hours prior to travel.

17.0 SPECIAL REQUIREMENTS

17.1 Notification of Requirements

Any special requirements, requests or needs must be advised to Travel at 60 at the time of booking, or as soon as reasonably possible thereafter. This includes (but is not limited to):

  • dietary requirements
  • mobility or accessibility needs
  • medical conditions
  • special assistance requirements
  • seating or rooming preferences
  • bedding configurations
  • special meal requests
  • travelling with mobility aids or medical equipment.

17.2 Requests Cannot Be Guaranteed

While Travel at 60 will make reasonable efforts to pass on and request any special requirements to the relevant Supplier, all special requests are subject to availability and cannot be guaranteed.

Confirmation of a special request by Travel at 60 does not constitute a guarantee that the request will be fulfilled by the Supplier.

17.3 Traveller Responsibility

It is the traveller’s responsibility to ensure that any special requirements are suitable for their needs and to make their own independent enquiries with the relevant Supplier where necessary.

Travel at 60 is not liable for any loss, inconvenience or expense arising from a Supplier’s inability to meet a special request, except to the extent caused by our fault.

17.4 Fitness to Travel

Some tours, cruises, flights and travel arrangements have specific physical or medical requirements. It is your responsibility to ensure that you are fit and able to participate in your chosen travel arrangements.

Where necessary, Suppliers may require medical clearance or additional information before confirming or permitting travel.

17.5 Additional Costs

Any additional costs associated with fulfilling special requirements (such as upgraded seating, special meals, accessible rooms, medical equipment transport or assistance services) will be at the traveller’s expense.

19.0 FORCE MAJEURE

19.1 Definition

A Force Majeure Event includes events beyond the reasonable control of Travel at 60 or suppliers.

Examples of Force Majeure Events include (but are not limited to):

  • natural disasters such as floods, fires, cyclones, earthquakes or severe weather events
  • pandemics or epidemics
  • government travel restrictions, border closures or quarantine requirements
  • airline or transport cancellations due to operational issues
  • strikes or industrial action
  • acts of terrorism, war or civil unrest
  • infrastructure or communication failures

Force Majeure does not include the insolvency of a supplier.

19.2 Effect

Travel at 60 is not liable for loss, delay or expense caused by a Force Majeure Event.

19.3 Changes and Cancellations

Where travel is affected by a Force Majeure Event, refunds and credits will be subject to supplier terms and conditions.

19.4 Consumer Law

Nothing in this clause limits your rights under the Australian Consumer Law.

19.5 Travel Insurance

Comprehensive travel insurance that includes Force Majeure cover is strongly recommended.

20.0 GOVERNING LAW AND JURISDICTION

21.1 Applicable Law

These Booking Terms & Conditions, and any dispute or claim arising out of or in connection with them, are governed by and are to be interpreted in accordance with the laws of the Commonwealth of Australia.

20.2 Jurisdiction

You irrevocably submit to the non-exclusive jurisdiction of the courts of Australia and any courts of appeal from them in relation to any legal action, claim or dispute arising out of or in connection with these Terms & Conditions or any booking made with Travel at 60.

20.3 Venue

Where permitted by law, any proceedings relating to these Terms & Conditions or your travel arrangements must be commenced in the courts of the State or Territory in which Travel at 60 Pty Ltd has its principal place of business.

20.4 Consumer Law

Nothing in this clause limits or excludes any rights you may have under the Australian Consumer Law or other applicable consumer protection legislation.
